Sellers Terms

The Seller Terms is an agreement between One-Off Moto Ltd. (“OOM”) and you, the Seller. These terms apply to individuals who elect to sell their motorcycle gear (“Gear”) to OOM for payment, (“OOM Service”).
Selling Process
A Seller completes the Intake Form on the OOM website and uses the shipping label sent by OOM to ship their Gear to OOM. OOM inspects the Gear, evaluating it on a set of criteria, to determine if it OOM will purchase the Gear. OOM will notify Seller of final payout amount for Gear and deposit the payout amount into Seller’s preferred payout destination.
Gear Evaluation
OOM evaluates each piece of Gear to a set of criteria to determine if the item is eligible for purchase and the payout amount. Criteria includes but is not limited to: condition, brand, authenticity of item, wear, and age of item. Full acceptance criteria and payout calculation rationale are confidential to OOM and not available for review by Seller.
Ownership of Gear
Seller represents and warrants that:
- they have an explicit right to sell the Gear;
- the Gear is not stolen;
- the Gear is not counterfeit;
- they intend to sell the Gear to OOM.
In the event OOM is contacted by law enforcement regarding stolen or counterfeit gear, OOM will cooperate and provide pertinent information needed to carry out their investigation. That information may include but is not limited to: your name, contact information, item(s) sent to OOM, and shipping address.
Payouts
OOM will provide payment in USD (“Payout”) to Seller for accepted Gear. Seller will be notified of Payout amount via email. Payout calculation and rationale is confidential to OOM and will not be shared with Seller. OOM reserves the right to adjust Payout amount calculations for any reason, including but not limited to: demand of market, economic environment, shipping rate fluctuations, and validity or popularity of a brand.
Payout will be provided via the Seller’s selected Payout method. OOM reserves the right at any time to add or remove Payout method options available to Seller.
Negotiations
OOM does not accept and will not participate in Payout negotiations of any kind with Seller, including but not limited to: Payout amount, Declined Gear Return fees, and Gear included in Payout Amount. If Seller holds uncertainty or hesitation in potential Payout amount or the general sale of their Gear, OOM advises that Seller does not participate in OOM Service.
Declined Gear Return (DGR)
If Gear sent to OOM does not meet specifications claimed by Seller in Intake Form, OOM does not guarantee the Gear sent by Seller will be accepted for Payout. Gear sent by Seller with tags on does not guarantee it is accepted. Gear sent by Seller that is not accepted by OOM (“Declined Gear”) becomes immediate property of OOM. Declined Gear will not be factored into the Payout amount.
Sellers who wish to have Declined Gear mailed back to them will be responsible for paying shipping and handling fees. Declined Gear is donated by OOM on behalf of Seller. OOM will not retain Declined Gear for sale or use of the Company.
OOM will not compensate or provide credit of any kind for donated Gear.
Incorrect & Forgotten Items
OOM reviews and accepts official motorcycle gear for potential Payout. For a list of current brands, items, and sizes we buy, visit our What We Buy page. Items purposefully or inadvertently sent to OOM that do not meet OOM buying standards will only be returned to Seller if Seller purchases and provides shipping label. OOM is not responsible for items left in pockets of Gear. Seller is encouraged to review Packing and Gear Prep Guidelines to avoid sending incorrect items.
Disputes
By using OOM Service, Seller acknowledges that OOM has no obligation to issue Payout or any further payment related or unrelated to a dispute with Seller until dispute is resolved.
Shipping
Sellers are encouraged to use the shipping label provided by OOM to ship their Gear. Shipping labels provided by OOM are at no cost to Seller. Sellers who elect to use their own shipping service inherit all risk and are fully responsible for tracking of shipment, payment for shipment, and accuracy of ship to address. OOM reserves the right to decline any shipment of Gear from Seller that was sent without prior completion of Intake Form and does not use OOM-issued shipping label.
Seller holds responsibility for their Gear until it arrives at OOM. OOM is not responsible for lost or delayed packages shipped to us. Seller is encouraged to note their tracking number on their label and track progress with the shipping carrier. OOM does not insure packages sent to us. Seller is solely responsible for the arrival of their Gear at OOM and is encouraged to utilize the Packing Guidelines to appropriately pack and ship their Gear. OOM is not responsible for the tracking or arrival condition of items shipped. OOM is not responsible for misplaced, lost, stolen, or damaged shipments from Seller
